1. Agreement to these Terms

These Terms of Service ("Terms") are a binding agreement between you and Butler County CPR ("Butler County CPR," "we," "us," or "our") governing your access to and use of our website, class registration, training classes, and related services (the "Services"). By registering for a class, making a payment, or using the Services, you agree to these Terms and to our Privacy Policy. If you register on behalf of an organization or another person, you represent that you are authorized to do so. If you do not agree, do not use the Services.

2. The Services

Butler County CPR provides CPR, BLS, ACLS, First Aid, and related safety training classes and certifications, along with the website tools used to browse, register, pay for, and manage those classes. We may add, change, or discontinue classes and features at any time. Class availability, prerequisites, and pricing are described on the applicable class pages.

3. Registration and accounts

You must provide accurate registration information and keep it current. You are responsible for the information you submit and for arriving prepared for your class. If you register minors or others, you are responsible for their information and for any required parental or guardian consent.

4. Fees, payment, cancellations, and refunds

Class fees are shown at registration and are due at the time of booking unless otherwise stated. Payments are processed by our payment processor (for example, Square); we do not store full payment-card numbers. Cancellation, rescheduling, no-show, and refund terms are described at registration and on the applicable class or policy pages; except as required by law or expressly stated, fees may be non-refundable. Registration for a class closes at the time shown for that class.

5. Class participation, conduct, and safety

CPR and first-aid training involves physical activity (for example, chest compressions and floor work). By registering and attending, you represent that you are able to participate or have consulted a physician, and you agree to follow instructor directions and safety guidance. You must also review and agree to our Liability Waiver, Assumption of Risk, and Media Release, which is incorporated into these Terms. We may remove or refuse service to anyone whose conduct is unsafe, disruptive, or unlawful.

6. Certifications

Certification cards are issued in accordance with the standards of the applicable credentialing body (for example, the American Heart Association) and are awarded only to participants who meet the completion requirements for the class. We do not guarantee that any certification will be accepted by a particular employer, school, board, or agency, and issuance of a card is subject to the credentialing body's rules. Certification validity periods are set by the credentialing body.

7. AI-assisted features

Some features may use artificial intelligence to assist with tasks such as grading quiz or skills responses ("AI Output"). AI OUTPUT IS PROVIDED "AS IS," MAY CONTAIN ERRORS, AND IS NOT A SUBSTITUTE FOR INSTRUCTOR JUDGMENT. Final grading, completion, and certification decisions are made or reviewed by qualified staff, not by AI alone. AI Output is not professional, medical, or emergency advice.

8. Electronic signatures and records

You agree that you may sign waivers, agreements, and related documents electronically, that your electronic signature is legally binding to the same extent as a handwritten one, and that you consent to receive records electronically. We retain electronically signed records and can reproduce them on request. You may request a paper copy by contacting us.

9. Third-party services

The Services rely on third-party providers (for example, payment processing, email delivery, analytics, spam protection, and credentialing bodies). Your use of those providers may be governed by their own terms, and we are not responsible for them.

10. Security — efforts, not guarantees

We use reasonable safeguards to protect information (see our Privacy Policy). However, no method of transmission or electronic storage is completely secure, and we do not and cannot guarantee that information will be free from unauthorized access, loss, alteration, or breach. To the maximum extent permitted by law, we disclaim any guarantee against data breaches or other security incidents.

11. Disclaimer of warranties

To the maximum extent permitted by law, the Services are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Our training is educational; it is not medical advice and is not a substitute for professional emergency medical care. We do not warrant any particular outcome, pass result, or that the Services will be uninterrupted or error-free.

12. Limitation of liability

To the maximum extent permitted by law, neither Butler County CPR nor its instructors, staff, or affiliates will be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or relating to the Services or your participation. Our total aggregate liability for all claims relating to the Services will not exceed the amount you paid us for the class giving rise to the claim. These limitations do not apply to liability that cannot be limited under applicable law, including gross negligence, recklessness, or willful misconduct, and they are in addition to the terms of our Liability Waiver and Assumption of Risk.

13. Indemnification

You will defend and indemnify Butler County CPR and its instructors, staff, and affiliates against third-party claims arising from your use of the Services in violation of these Terms or law, or from information you provide, except to the extent caused by our own breach of these Terms.

14. Changes to these Terms or the Services

These Terms and the Services are always subject to future revision and update. We reserve the right to change, add to, or remove any part of these Terms or the Services at any time, in our sole discretion. We will post the updated Terms with a new "last updated" date, and your continued use after the effective date means you accept them. Please review these Terms periodically.

15. Governing law; jury waiver; exclusive venue

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules. EACH PARTY KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVES ANY RIGHT TO A TRIAL BY JURY in any action arising out of or relating to these Terms or the Services. Any action or proceeding arising out of or relating to these Terms or the Services shall be brought exclusively in the Court of Common Pleas of Butler County, Pennsylvania (50th Judicial District), or, solely where federal subject-matter jurisdiction exists, in the United States District Court for the Western District of Pennsylvania. Each party irrevocably consents to the personal jurisdiction and venue of those courts and waives any objection based on forum non conveniens or improper venue.

16. General; contact
